1st Best Practices CERCLA Training Workshop

Project Navigator, in concert with C2REM and demaximis, hosted a 2-day CERCLA Training Course in Houston, TX on September 25-26, 2007. The course focused on management and strategies at multi-party environmental projects and provided participants with insights into Superfund fundamentals, project drivers, and recommendations to promote cost-effective solutions for site remediation activities.

A "Best Practices Group" for CERCLA benchmarking studies was formed in 2004 by Chevron Corporation. As the Group developed, it has become a forum for companies to share ideas, experiences and current practices regarding the management of complex remediation challenges. The Group is also a mechanism for member companies to gain perspective on the management practices of their peers.

In mid-2006, the Best Practices Group identified the need to create a training course for the education of internal Project Managers on CERCLA multi-party sites. There appears to be a need for this course since no formal, industry-oriented, multi-party training course presently exists in the marketplace.

With the full backing of the Best Practices Group, Project Navigator, Ltd. (PNL) and de maximis inc., in association with C2 REM, are hosting a two-day interactive training course on leading and managing environmental sites with multiple responsible parties, e.g., Superfund, State Superfund, and other voluntary cleanup programs.

The two-day training course, which is being held in Houston, Texas, will focus on management and participation practices and strategies at multi-party environmental projects. While this course will discuss the legal and regulatory framework, its main focus is on how to programmatically and cost-effectively manage complex remediation projects.

The course will provide participants with insights into Superfund fundamentals, project drivers, and recommendations and strategies to promote cost-effective solutions for site remediation activities.

Additionally, the course will focus on solving some of the unique challenges of CERCLA site management, including allocation, technical negotiations, remedy selection, post remedy selection changes, and where a PM should expend effort to effect maximal change in his/her employer's interests.

Paul R. Portney became Dean of the Eller College of Management in July 2005. He also holds the College’s Halle Chair in Leadership and is a Professor of Economics.

From 1972 through June of 2005, Portney was with Resources for the Future (RFF), an independent and non-partisan research and educational organization in Washington, D.C., that specializes in energy and the environment. From 1986-1989 he headed two of its research divisions, in 1989 became its vice president, and was named president and CEO in 1995.

At RFF, Portney was instrumental in expanding the research staff, reinforcing the high quality of its analyses, and ensuring that its work was communicated clearly and effectively to policymakers, business leaders, journalists, environmental advocates, and academics.

From 1979-1980, Portney served as chief economist for the White House Council on Environmental Quality. He has held visiting teaching positions at both the University of California at Berkeley (1977-1979) and Princeton University (1992-1994), and since 1981 has been a core faculty member for The Washington Campus—a consortium of nearly 20 graduate schools of business that offer classes in Washington for both full-time and executive MBA students—and continuing education programs for major corporations.

Since 1999, Portney has been a member of and has chaired the Finance and Investment Committee for the Johnson Foundation, one of the charitable arms of the Johnson family of Racine, Wisconsin. Until 2005, he was a member of the Sustainable Forestry Board, serving with the CEOs of five major forest products companies and the heads of five environmental organizations.

Pam Phillips has been with the Agency since 1979. She has been the Deputy Director of the Superfund Division since 1995. The Superfund Division includes the Superfund program, the Oil Pollution Act response and enforcement program, and the Brownfields program. Region 6 includes Arkansas, Louisiana, New Mexico, Oklahoma, and Texas.

Pam started as an enforcement attorney and was the lead Agency attorney on many of the original Superfund and RCRA cases filed in Region 6. She has worked in all of the Agency enforcement programs, but has spent most of her time in the Superfund program. In 1994 and 1995, Pam worked in the Office of the Regional Administrator as the Enforcement Coordinator. Through the years Pam has had several long term details to EPA's headquarter offices in Washington, D. C. to work on everything from contract issues to Superfund programmatic issues. Pam is one of the few people in Region 6 who has worked in both the legal offices and the programmatic offices.

Dr. Ian A. Webster is President of Project Navigator, Ltd., which he formed in 1997, after working at Unocal Corporation on environmental matters for 14 years. Ian's key strengths are in project management, remedial engineering and negotiations. One of his core activities is in working with clients to understand their goals and drivers, then devising both immediate and long-term project strategies, which, at their very heart, are formulated to achieve compliance and save money. Ian spends much internal time assuring that Project Navigator's commitment to deliver quality, innovative product on schedule, is upheld. He also works to assure that the creative solutions track record that Project Navigator has developed with its clients will be maintained and improved, in parallel to the organization's growth.

All of Ian's degrees are in chemical engineering. He has a B.Sc. (1st class honors) from University of Strathclyde (Glasgow, Scotland), 1976; a M.S. from Cornell University, 1979; and a Sc.D. from Massachusetts Institute of Technology (1984).

He has authored, or coauthored, over 30 publications in the field of reaction engineering and environmental site remediation.

Ian's last assignment at Unocal, prior to forming Project Navigator, Ltd. was as chief engineer, Superfund projects, where he managed $10MM's of the company's liabilities.

Mr. Roberson is registered Professional Engineer with 30 years of total industry experience. Specifically the last 15 years has focused on project management and direction of major remediation projects. With over 20 years of total engineering experience with a major international oil company before joining de maximis, inc., Mr. Roberson is capable of managing major environmental projects, representing clients before environmental and regulatory agencies, and leading multi-party PRP groups to settlements with agencies and other third parties. In addition to environmental work, Mr. Roberson has extensive petroleum engineering experience, working with oil and gas reservoirs in West Texas and Oklahoma.

Edmond F. Bourke
President, C2 REM

Mr. Bourke is the President of C2 REM, an environmental management and development company founded in 1995. Mr. Bourke is also the President of BRE Management, a real estate asset management company founded in 2002. Mr. Bourke has over 20 years of notable accomplishments in the oversight, management, and implementation of development and environmental engineering services to oil and chemical companies, redevelopment agencies, utility companies, and developers. Mr. Bourke's main focus is to provide cost effective remedial and development objectives that meet and exceed his clients goals. Over the years, he has developed strong and meaningful relationships with many clients, agency representatives and his peers in the environmental and development fields.

Mr. Bourke's strengths include: directing and managing large CERCLA projects; onsite coordination of engineering services and construction activities; as well as directing and managing effective site closure strategies including site redevelopment. Mr. Bourke was also the President of Legends Golf, LLC which after negotiating the acquisition and entitlement of the land and fully developing a golf practice facility, conducted the successful site redevelopment of a 130,000 square foot office retail and warehousing facility, which was sold prior to construction.

In addition to Mr. Bourke's business endeavors above, he worked for TRC/Environmental Solutions in the late 1980s through early 1990s as a Project Manager/Principal Reviewer where he developed a strong track record as an experienced Project Director and a key team member for over 25 federal Superfund Remediation projects and over 100 environmental projects collectively.

Jim Dragna focuses on counseling and litigation matters in all environmental media, with a particular emphasis in waste, wastewater and water rights matters. Prior to entering private practice, he served as senior trial counsel at the U.S. Department of Justice, Environmental Enforcement Section in Washington, D.C., where he managed the EPA's environmental enforcement litigation in Regions IX and X. Before that, he was a founding member of the EPA’s Hazardous Waste Enforcement Task Force, the entity responsible for the development of the EPA’s Superfund Program. While at the Department and the EPA, he represented the EPA in a wide range of environmental enforcement actions across the nation.

Jim now represents energy, aerospace and manufacturing clients in a wide range of environmental matters, including air, water and wastewater counseling, enforcement and litigation matters nationwide. His practice also includes the representation of water purveyors in water rights cases, including litigation involving Native American water rights. He also has served as group or common counsel to several multiparty Superfund groups, in addition to representing a host of individual clients in over 50 federal or state Superfund matters nationwide. This work has included the negotiation of complex settlement agreements, contribution litigation, and the creation of insurance and long term financial management products to fund long-term remedies.

Mr. Giannotti has more than 30 years of extensive environmental law experience, covering air, water, toxic substances, Superfund, and hazardous waste issues ranging from compliance to litigation. Mr. Giannotti also has extensive experience in due diligence investigations as well as developing and implementing environmental auditing programs for clients.

Mr. Giannotti's experience was gained during a career that began in private practice and included almost ten years as an environmental attorney with Occidental Petroleum Corporation. During his last three and a half years at Occidental, he was Counsel - Environmental, Health & Safety, with responsibility for the company's worldwide operations. He also served as counsel to Occidental's Board of Directors' Environmental Committee. Before joining Occidental's headquarters staff, he spent six years in its chemical division as its environmental attorney. He returned to private practice in 1984.

In the Superfund area, Mr. Giannotti has represented clients at sites in California, New York, New Jersey, Ohio, Texas, Utah, Michigan, Washington, Florida and Oklahoma. For example, he has served as Common Counsel to a group of more than 130 companies at a site in Los Angeles, California since 1986, providing diverse legal services, including lead attorney in negotiating the largest partial settlements to date in EPA's Superfund program totaling over $650 million.

Mr. Giannotti has had broad experience conducting environmental due diligence reviews, including acting as lead environmental counsel and overall manager of such efforts in connection with multi-billion dollar business transactions. This experience has included post-closing activities to address environmental issues and to assure ongoing compliance.

John McGahren is the Managing Partner of the New Jersey office of Patton Boggs. Mr. McGahren handles a wide variety of environmental litigation, enforcement, and compliance matters, ranging from hazardous waste litigation to counseling industrial clients on federal and state regulatory matters. He also assists clients on issues involving alternative dispute resolution and government contract claims.

Before his arrival at Patton Boggs, Mr. McGahren was a partner in a large international law firm and the local chair of the environmental department. He was also a licensed professional engineer in the U.S. Environmental Protection Agency (EPA) Region II Superfund program, where he worked on sites in New York, New Jersey, and Puerto Rico.

Mr. McGahren’s charitable endeavors include New Jersey Battered Women’s Service, Inc., Habitat for Humanity, Lawyers Asylum Program, The Heifer Society, District of New Jersey Federal Mediator, and New Jersey Supreme Court Civil Mediation Program State Mediator.

Professional Credit (MCLE)

The Best Practices CERCLA Training Course has been approved for MCLE credit. As a result, attorneys will receive 13.5 participatory hours at the completion of the course.

Minimum Continuing Legal Education (MCLE) Requirements

State Bar of Texas -

Every active member of the State Bar must complete a minimum of 15 hours of accredited continuing legal education (CLE) during each MCLE compliance year. Of the minimum 15 hours, at least 10 of the hours must be earned in the form of formal courses or seminars. Five of the 15 hours can be in the form of self-study activities that would include reading legal periodicals, viewing videotapes or listening to audiotapes. At least three hours of the minimum 15-hour requirement must be in the area of legal ethics/professional responsibility; one of the minimum three-hour requirements may be completed in the form of self-study credit.

State Bar of California -

Total hours required every three years: 25 hours

  • Maximum "self-study" hours: 12.5 hours
  • Members must fulfill at least one-half of their MCLE requirement with activities approved for "participatory" MCLE credit.
  • Special Requirements within the total hours required (may be taken as participatory or self-study):
    • Legal Ethics: 4 hours (required)
    • Detection/Prevention of Substance Abuse: 1 hour (required)
